On September 27, 2011, in a dank and filthy circus camp in Aurangabad, Maharashtra, a 24 year old female elephant named Chanda gave birth to her second calf, a tiny baby girl named Suman. Suman’s father Bijli – a magnificent bull despite his missing left tusk – was also at the circus. Further off, her older sister stood restrained uncomfortably by both her feet, her head swaying monotonously.

That night signaled the beginning of Suman’s story, one that has been riddled with terror, suffering and fear – despite just being 6 years old.

In 2013, two years after she was born, Suman, Chanda and Bijli were illegally sold by the Moonlight Circus to the father of a man named Sameer ‘Ballu’ Khan, and illegally trafficked across state borders to the city of Jaipur in Rajasthan. The transfer of ownership of the elephants was done without any of the requisite paperwork, those involved being wholly aware of the illegality of what they were doing.

Today, Sameer Khan, who inherited the elephants from his father is widely regarded as the most cruel of all the elephant owners in Jaipur, a city widely regarded as the most cruel place in the country to the over 100 elephants that are held captive and exploited there. Horrifying footage and stories of him mercilessly beating his elephants with weapons including axes, burning the delicate footpads of their feet and of the number of his elephants that seem to die early, unnatural deaths emerge constantly, leaving us in no doubt of the authenticity of the claims of his evil disregard for the lives of the gentle giants he exploits for money.

A year passes, and the cruelty baby Suman experiences over these days is only an initiation into what she is going to go through in the coming years, and possibly the rest of her life. She is being indoctrinated into captivity, undergoing a brutal process aptly called ‘breaking the spirit’ of the elephant, to prepare her for a life of subservience to cruel human masters. Then, in 2014, Suman finds herself being transported to the state of Gujarat to star in a TV show. The process of training her for the show, and the conditions she is forced to live in during shooting result in animal welfare groups campaigning for the shows end and Suman being relieved from her exploitation. Abruptly, the show is taken off-air and the baby elephant is returned back to Jaipur.chanda-carrying-tourists_01

Another year passes, Suman is housed near her mother, but restrained so tightly she can’t reach her. Her father Bijli is rented out to weddings and processions, much in demand being one of the only two bulls in the city. His missing tusk is camouflaged with a heavy false tusk, fixed awkwardly onto him and hidden under heavy, uncomfortable and gaudy decorations. Chanda, the mother, also spends her days garishly caparisoned at the Amer Fort, slowly and excruciatingly making her way up the arduous climb to the top of the fort with a heavy carrier pressing down on her protruding spine, filled with tourists and a handler that keeps a sharpened stick always at the ready to punish her for any steps out of place or exhausted resistance.

In 2015, the three elephants’ original home – The Moonlight Circus – is shut down on grounds of legal violations and the four elephants still in the circus, including Suman’s sister, are rescued by Wildlife SOS and taken to our rescue centre in Mathura to live out the rest of their lives surrounded by people that care for them, and other elephants, receiving medical care, and every amenity they need to thrive in their new home. The elephants are nicknamed the Nutherd, and the youngest of these four elephants, the first daughter of Bijli and Chanda, is named Peanut – the much adored baby of the Wildlife SOS Elephant Conservation and Care Centre.

Shortly after we rescued the Nutherd, and Peanut, we found out she had a sister, and that her parents were in captivity too – we investigated the claims, and followed multiple leads till dead ends, before stumbling upon the three elephants in Jaipur – exploited, tortured and denied everything, including each other’s company. It broke our hearts. Peanut’s rescue, her gradual development into the naughty, wonderful and gleeful young calf she is today gives us so much joy, but in the back of our hearts, Suman’s story – and that of her parents – casts a depressing shadow. We have to get her out.

Last year, we introduced Suman tentatively to our supporters – but use the name Hazel and cropped pictures of her to avoid risking the lives of our sources and jeopardizing her rescue. All the while we struggle to gather intelligence on the elephant – she is hidden away now, chained in a basement that she is never allowed to leave. We hear heartbreaking stories of how she is no longer allowed to see her mother because they both get so overwhelmed and cry when they see each other. We hear she ran amuck when she was taken out last, she’s a baby elephant so it isn’t at all surprising that she still has a little spirit left in her – but that ever since then, she isn’t even taken out anymore, just tightly restrained by two feet in the dungeon that is her home now.chanda_o1

She sways her head miserably, monotonously. She’s stressed, bored and scared – worst of all she is alone, except for humans that hurt her. At the fort, and at tourist spots across the city, Chanda lugs tourists around on her back in the blistering heat, her footpads searing on the hot tarred roads and rocky streets. She must be in unimaginable anguish, but the pain of losing her babies – twice – must be infinitely worse. As a bull, Bijli is hidden away, likely being beaten regularly to keep him submissive, despite all the anguish humans have imparted him.Bijli_dad

Their status in Jaipur is never legalized, since their sale and transport was illegal, but the government, the Forest Department, everyone entrusted with ensuring their welfare, seems oblivious to their existence. Attempts are made to sell them which we manage to put a hold on, even as attempts are made to obtain false documents for the three.

Just as the authorities turn a blind eye to the plight of these three elephants, they turn a deaf ear to our repeated attempts to reach out to them for help. Tourism drives the city of Jaipur, and the elephants drive tourism – a government that takes a stand to actually enforce the law for the welfare of these animals also stands to lose favor amongst the locals, and a lot of tourism money.

We feel helpless, but we cannot give up on Suman and her family. As a baby, she is faced with an uncertain future – either 50 years of abuse, beatings, neglect and fear or 50 years of safety, kindness, veterinary care and love from people and other elephants at our rescue centre. Five decades of cruelty, or five decades of care. We are reaching out to our supporters, and elephant lovers across the world to stand strong for Suman and ensure her future is safe with us – please join us in imploring the authorities in Jaipur to save Suman and her family and reunite her with her sister in ECCC.

The information we have shows that we can’t wait any longer for the authorities to take action and we need international pressure to speak out on behalf of Suman and her family.  Their freedom will come with international pressure.  

The ways you can take action are to:

  1. Sign the petition to the Chief Wildlife Warden asking for their freedom.  He has the power to take action on behalf of all 3 elephants.
  2. Share this link with people who love elephants that explains the campaign.
  3. Stay informed- we will be doing regular updates with new ways you can help.
  4. Boycott elephant attractions in Jaipur like the Amer Fort and report to your travel agent/guide that the reason you don’t want to go is because of the cruelty inflicted upon the elephants there.
  5. However, if you or someone you know is visiting Jaipur- tell them to keep an eye out for elephant 112 carrying tourists up to the fort,  a baby elephant and male elephant with one tusk missing (although he is sometimes fixed with a prosthetic tusk.).  Very few male elephants live in Jaipur so there is a high likelihood that any males could be Bijli. We will be doing everything we can to keep an eye on these elephants.  We will be spending what we can on a public awareness and pressure campaign to help these elephants get freedom.

It probably comes as no surprise to you that plastics have been found nearly everywhere in our ocean—from the deepest reaches of the Mariana Trench to the most remote Arctic ice. Marine debris and plastic pollution pose a serious threat to our ocean and the wildlife and communities that depend on it.

Congress has taken on the issue of marine debris through the Save Our Seas 2.0 Act. The Senate passed the legislation unanimously, and now it is up to the House to pass the bill so that it can be signed into law!

Will you take action and tell your Representative to support this legislation?

Your Representatives need to hear from their constituents that the issue of marine debris and plastic pollution is a problem that you want them to tackle. The bill:

  • Proposes a variety of new measures to bolster international engagement and cooperation to research and address the marine debris crisis;
  • Commits resources to scientific research to better understand solutions to plastic pollution, both here in the U.S. and around the world; and
  • Proposes a host of new efforts here at home to improve our waste management systems, particularly recycling infrastructure. For example, the bill creates a loan program for states to support trash wheel and litter trap technologies.

The Senate has already taken decisive action in the fight against marine debris by passing this important legislation. It is now up to the House of Representatives to vote on this bill so that it can be passed into law.

Boasting some of the richest biodiversity in the world, Australia is estimated to be home to as many as 300,000 different species of animals. In such company, it takes a truly iconic animal to fill the role of Australia’s national animal — and the kangaroo certainly lives up to the task. Immediately recognizable are their long, powerful legs, allowing them to travel over six feet per leap, and the pouch they sport on their belly for carrying their young. But even their emblem status does not keep them safe from the whims of humans. Kangaroo skin, strong but light, has long been sought after for things like football (or soccer in the U.S.) cleats, baseball mitts, and many types of gloves. California, a U.S. state known for leading the way in animal welfare policy, was ahead of its time when it banned the sale of products made from kangaroo skin all the way back in 1971. But in 2020, an investigation discovered that some huge brands thought they were above the law. Nike and Puma have both been selling kangaroo leather products in California despite the ban!

Sign the petition today if you want Nike and Puma to do the right thing and abide by California law! Tell them to stop selling kangaroo leather products in the state, and commit to phasing out the use of kangaroo leather company-wide!

These kangaroos are ripped from the wild, stolen from their families and lush homes. The Australian government dictates that kangaroo hunting must be done with a firearm, which is cruel enough — but when it comes to the most vulnerable, like babies or adult kangaroos that are already wounded, the cruelty is amplified. These poor animals have their heads severed from their bodies, or they are painfully bludgeoned to death. The officially stated reason for this heinous method is to “destroy the brain,” and apparently any semblance of humanity. California’s law is an indirect attempt to curb this brutality. Companies like Nike and Puma disregarding said law puts pain and profit above compassion and animal welfare.

Ideally, kangaroo leather would be totally banned worldwide. With advanced technology and a wide variety of synthetic materials at our disposal, using the skin from innocent animals for our luxury sport equipment is simply outdated and cruel. But passing laws that keep these products off the shelves is the right step towards making them obsolete, and Californai did that! But statewide laws can be difficult to enforce when these companies sell to states and nations all over the world. That means that it is Nike and Puma’s responsibility to do the right thing and abide by the law! They have the time, money, and resources to do so — any noncompliance is a result of negligence, apathy, and a gross misuse of power.

If we speak out enough, we can really get Nike and Puma where it matters most — in their profits. Let’s make sure that they know we are watching, and until they decide to put animal welfare first, we won’t rest! Sign the petition and demand that Nike and Puma comply with California law, halting the sale of products made with kangaroo skin in the state, and then take it one step further by phasing out all kangaroo leather products!

Victory! Federal Judge Rules Administration’s Bird-Killing Policy is Illegal

NEW YORK – “Like the clear crisp notes of the Wood Thrush, today’s court decision cuts through all the noise and confusion to unequivocally uphold the most effective bird conservation law on the books–the Migratory Bird Treaty Act,” said Sarah Greenberger, Interim Chief Conservation Officer for the National Audubon Society. “This is a huge victory for birds and it comes at a critical time – science tells us that we’ve lost 3 billion birds in less than a human lifetime and that two-thirds of North American birds are at risk of extinction due to climate change.”

United States District Court Judge Valerie Caproni ruled today that the legal opinion which serves as the basis for the Trump administration rollback of the Migratory Bird Treaty Act does not align with the intent and language of the 100-year-old law. In her ruling, Judge Caproni found that the policy “runs counter to the purpose of the MBTA to protect migratory bird populations” and is “contrary to the plain meaning of the MBTA”.

Today’s decision comes as a result of a series of lawsuits brought in 2018 by Audubon, several other conservation groups, and eight states.

“With today’s court decision, the administration should abandon the regulatory process it started to make this illegal bird-killing policy permanent,” said Greenberger. “With the legal basis for its actions over the past year defeated the administration should expect more defeats in court if they try to lock-in their attempt to roll back the MBTA.”

The administration is nearing the end of a regulatory process to make the legal opinion ruled on today permanent in the form of regulation. The changes overturn decades of bipartisan precedent to say that the MBTA’s protections apply only to activities that purposefully kill birds, exempting all industrial hazards from enforcement. Any “incidental” death—no matter how inevitable, avoidable or devastating to birds—becomes immune from enforcement under the law.

Judge Caproni’s response to this opinion is clear: “There is nothing in the text of the MBTA that suggests that in order to fall within its prohibition, activity must be directed specifically at birds. Nor does the statute prohibit only intentionally killing migratory birds. And it certainly does not say that only “some” kills are prohibited.”

“For decades this law has been a proven incentive to remind companies to do the right thing for wildlife,” added Greenberger.

The Migratory Bird Treaty Act is a common-sense law that requires companies to do things like cover oil waste pits, which birds mistake for bodies of water, and implement best practices for power lines to reduce bird electrocutions and collisions, among other actions. If the administration’s legal opinion had been in place in 2010, BP would have faced no consequences under the MBTA for the more than one million birds killed in the Deepwater Horizon oil spill. 

This reality is underscored by Judge Caproni’s own words from the opening of today’s ruling: “It is not only a sin to kill a mockingbird, it is also a crime. That has been the letter of the law for the past century. But if the Department of the Interior has its way, many mockingbirds and other migratory birds that delight people and support ecosystems throughout the country will be killed without legal consequence.”

WHAT IS PESTICIDE DRIFT?

Pesticide drift happens when pesticides move through the air from the intended application site to places they shouldn’t be – homes, schools, neighboring farms, playgrounds, bee yards, etc.

WHAT ARE THE POSSIBLE SIDE EFFECTS FROM PESTICIDE DRIFT?

Short-term impacts: headaches and nausea to chronic impacts like cancer, reproductive harm, and endocrine disruption.  

Acute dangers: such as nerve, skin, and eye irritation and damage, headaches, dizziness, nausea, fatigue, and systemic poisoning – can sometimes be dramatic, and even fatal.  

WHY IS IT A PROBLEM?

Pesticide drift can cause economic, environmental, and human health damage. Farmers are frequently unable to sell crops that have been damaged by drift, especially if the crops were certified organic. Livestock can become ill, and sometimes die, when exposed to drifting pesticides. People can experience short term health issues such as burning skin, vomiting, headache, dizziness, and difficulty breathing, and long term conditions including asthma, fatigue, depression, infertility, miscarriage, birth defects, some forms of cancer, increased chemical sensitivity, and neurological impairments. 

WHAT SHOULD I DO IF PESTICIDE DRIFT HAS IMPACTED ME OR MY FAMILY? 

  1. REPORT IT IMMEDIATELY!!! We know it’s tough to deal with government bureaucracy sometimes, but reporting it will help us all by keeping track of the number of drift incidents in the state. Hopefully, it will also help you find a resolution to the problem you’re facing. Remember Toxic Taters is here to help. In Minnesota, reports should first be reported to the MN Poison Control System anytime by calling 1(800)222-1222 or online at http://www.mnpoison.org/.  You can fill out a complaint online through the Minnesota Department of Agriculture (MDA) at https://www.mda.state.mn.us/pesticide-fertilizer-misuse-complaint-form#no-back or call the Minnesota Department of Agriculture; Reports can be made by telephone at 651-201- 6333 (8AM-4PM).  After hours, contact the Minnesota Duty Officer at 1-800-422-0798.  On the White Earth Indian Reservation call the Pesticide Coordinator at 218-935-2488 ext. 2115. 
  2. Call a doctor immediately and report exposure. Ask to have your report put in your medical file. Ask what symptoms you should watch for and what medical remedies are available.
  3. If people were exposed to drift, put any clothing worn at the time of exposure into an airtight plastic bag and put the bag in the freezer. Provide this bag to the investigator.
  4. Document everything in writing. Include dates, times, and as much detail as you are able as soon as possible.
  5. For drift incidents in Minnesota, call Toxic Taters at 218-375-2600 for additional information and support.

WHAT SHOULD I RECORD IF I OR MY FAMILY EXPERIENCE PESTICIDE DRIFT?

If you or your family experience pesticide drift, keep a record of everything you notice during and after the incident.

  1. Date, time and details of the incident, including weather (wind direction and speed/strength, precipitation at the time of drift and between drift incident and sampling, and temperature) and any odors in the air (like sweet, sulfur, skunk, other).
  2. Affected crops and other land — include photos
  3. Pesticide applicator name, contact information, prior notification, spray plane description, and FAA registration number
  4. Owner of the land intentionally sprayed and types of crops sprayed
  5. Who was affected; how they were exposed; symptoms; medical attention sought
  6. Chemical compounds involved, if known
  7. Organic certifier test results and notification information (if you are an organic grower)
  8. MN Department of Agriculture Investigation: dates, times, samples, test results, orders, investigation case file (after release)
  9. White Earth Natural Resources Investigation: dates, times, samples, test results, orders, investigation case file (after release)
  10. Potentially provable damages (value of crop ordered destroyed, documented loss of sales, loss of organic certification, response costs)

FORESTS TO FRIES

Toxic Taters has been working since early 2015 to protect Hubbard, Becker, Wadena, and Cass counties from an RDO expansion that has been threatening thousands of acres of the pines with conversion into potato fields.  

In February of 2015 RDO was seeking 54 new well permits in the Pineland Sands Aquifer.  Thanks to citizen pressure one year later only one well has been approved and two additional permits are in process.

As of February 13th, 2016 we haven’t gotten the DNR to require that RDO do an environmental assessment, but we’ve effectively paused the expansion.  

Now, we are calling on RDO’s major buyer, McDonald’s to show their commitment against deforestation by telling RDO forests are worth more than fries.  

We will continue to work to protect the water, land, forests, and communities of the Pinelands Sands Aquifer from RDO Expansion.

The following position statement regarding GMO’s was adopted by the Toxic Taters Leadership Team on 9-28-15.

Toxic Taters does not support GMOs.  Research has linked GMOs with increased pesticide use. We recognize the increased use of pesticides along with other attributes of genetically modified organisms to harm the environment and human health, as well as cause negative impacts on the livelihoods of non-GMO and organic farmers.  We believe that the well-being of the earth and its inhabitants for generations to come must be prioritized over corporate profits.  This does not occur with GMOs and therefore we cannot support their use.

U. S. Senator Kamala Harris is not a United States citizen. Demand her deportation immediately.

U.S. Senator Kamala Harris must be arrested and deported immediately for immigration fraud.

Harris was born Oct. 20, 1964. At the time of her birth, her father Donald Jasper Harris, was a citizen of Jamaica, and her mother Gopalan Shyamala, was a citizen of India. Therefore, the laws of both Jamaica and India are clear: Kamala Harris was either a citizen of Jamaica, pursuant to Section 3C(b) of the Constitution of Jamaica, or a citizen of India, pursuant to Part II, Sec. 5 of the Constitution of India.

When I read that Sleepy Joe Biden came out of the basement to announce his pick for running mate; and then I read that it was Kamala Harris, I knew I needed to uncover her Socialist leanings. 

What I didn’t know was how easy it would be to find this information.

Kamala Harris is the daughter of a Marxist Professor.

And because we know that the apple does not usually fall far from the tree – folks, we have a bona fide Marxist running for VP for the Democratic Socialists of America. 

Oh, if you asked Sleepy Joe if he is on board with Marxism, you would get the ‘Deer in the headlights look’ as he would attempt to answer. He would forget where he was, and would fumble bumble over Marxism. I actually feel pretty sorry for the man.

Manhattan Man Sentenced to 15 Years in Prison for Attempting to Provide Material Support to Terrorist Organization

The Department of Justice announced today that Jesus Wilfredo Encarnacion, a/k/a “Jihadistsoldgier,” “Jihadinhear,” “Jihadinheart,” “Lionofthegood,” was sentenced to 15 years in prison for attempting to provide material support to Lashkar e-Tayyiba (LeT), a Pakistan-based designated foreign terrorist organization responsible for multiple high-profile attacks, including the infamous Mumbai attacks in November 2008.  In addition, Encarnacion was sentenced to a lifetime term of supervised release.  Encarnacion pleaded guilty on Jan. 22, 2020, before United States District Judge Ronnie Abrams, who also imposed today’s sentence.

“Unfortunately, individuals continue to attempt to travel to foreign countries to support terrorist organizations.  Encarnacion’s sentence reflects the seriousness with which the justice system takes these efforts,” said Assistant Attorney General for National Security John C. Demers.  “The National Security Division remains committed to identifying and holding accountable those who seek to join and support designated foreign terrorist organizations.”

“Jesus Encarnacion plotted to travel abroad, to join and train with Lashkar e-Tayyiba, infamous worldwide for the jihadist murder of innocent civilians, and to carry out shootings, bombings, and beheadings in behalf of that terrorist organization,” said Acting U.S. Attorney Audrey Strauss for the Southern District of New York.  “Thanks to the FBI, the NYPD, and the Joint Terrorist Task Force, Encarnacion has been sentenced to a lengthy prison term for his crime.”

According to the criminal complaint, indictment, other court filings, and statements during court proceedings:

In November 2018, Encarnacion expressed his desire to join a terrorist group in an online group chat, where he met another individual (CC-1).  CC-1 introduced Encarnacion to an individual who, unbeknownst to CC-1 or Encarnacion, was in fact an undercover FBI employee (UC-1).  Encarnacion repeatedly expressed, in the course of recorded communications through a social media service with CC-1 and through an encrypted messaging service with UC-1, his allegiance to and support for LeT, which, since approximately 2001, has been designated as a Foreign Terrorist Organization by both the United States Secretary of State and the Immigration and Nationality Act. 

Over several months, Encarnacion discussed his desire and plans to join LeT overseas so that he could receive training and participate in violent acts of terrorism.  For example, Encarnacion told UC-1 that he was “ready to kill and die in the name of Allah” and sought UC-1’s assistance to help Encarnacion travel abroad to serve as an “executioner” for LeT, stating, “I want to execute.  I want to behead.  Shoot.”  Encarnacion further stated that he aspired to commit terrorist attacks (“a bombing and shooting”) in the United States, but lacked “guidance” and “guns” to do so.

By early 2019, Encarnacion and UC-1 agreed on a plan that Encarnacion believed would allow him to join LeT in Pakistan.  Encarnacion told UC-1 that he had made arrangements to travel to a particular city in Europe (the “European City”), as the first step in traveling to Pakistan to join LeT.  Encarnacion purchased an airline ticket for a flight scheduled to depart on Feb.7, 2019, from John F. Kennedy International Airport (JFK Airport) to the European City.  On Feb. 7, 2019, Encarnacion traveled to JFK Airport, where he was arrested by the FBI after he attempted to board that flight.

In addition to the prison term, Encarnacion was also sentenced to serve a life term of supervised release.

Assistant Attorney General Demers and Ms. Strauss praised the outstanding efforts of the FBI’s New York Joint Terrorism Task Force, which principally consists of agents from the FBI and detectives from the New York City Police Department.  Ms. Strauss also thanked the Counterterrorism Section of the Department of Justice’s National Security Division, as well as the New York Office of U. S. Customs and Border Protection.

This prosecution is being handled by the Office’s Terrorism and International Narcotics Unit.  Assistant U.S. Attorneys David W. Denton Jr. and Kimberly J. Ravener are in charge of the prosecution, with assistance from Bridget Behling of the National Security Division’s Counterterrorism Section.
